Minutes of the Special Session of Municipal Council held at the Nictaux & District Fire Hall, 9349 Highway 10, Nictaux, NS, on September 21, 2015, at 7:15 p.m.

Present: Warden Reg Ritchie, Deputy Warden Timothy Habinski; Councillors Marilyn Wilkins, Brian “Fuzzy” Connell, Wayne Fowler, Paul McDonald (7:04), Frank Chipman, Martha Roberts, Diane LeBlanc, and Horace Hurlburt.

Absent:  Councillors Gregory Heming, Alex Morrison.

Present: CAO John Ferguson, Director of Community Services Albert Dunphy, Municipal Clerk Carolyn Young, and 4 members of the public.



The Warden noted that this special session had been called in order to expedite the process for an amendment to the East End Area Land Use Bylaw.

Re: Application No. 2015-MPS/LUB-003: Annapolis County East End Area Land Use Bylaw Amendment – Road Frontage Relaxation

MOTION 150921.01              Annapolis County East End Area Land Use Bylaw - Amendment

Pursuant to the recommendation of the Planning Advisory Committee, Deputy Warden Habinski moved, seconded by Councillor Chipman, that Municipal Council approve the Annapolis County East End Area Part 7.21 land use by-law text amendment and give 1st reading of Council’s intention to amend the East End Area Land Use Bylaw so as to add the wording “Notwithstanding the minimum lot frontage requirements of this Bylaw, development permits shall be issued for development on lots created pursuant to the Subdivision Bylaw, where an existing lot that lacks frontage along a provincial or municipal street or highway or private road contains two or more existing main buildings is subdivided such that the normal frontage requirements cannot be met, provided that the new lot and the remainder lot contain at least one main building and all other applicable requirements of this Bylaw are satisfied.” to Part 7.21 of the Annapolis County East End Area Land Use Bylaw. Motion carried unanimously.

MOTION 150921.02              Annapolis County East End Area Land Use Bylaw Amendment – Public Hearing October 20, 2015

Deputy Warden Habinski moved, seconded by Councillor Chipman, in accordance with the recommendation of the Planning Advisory Committee, that Municipal Council hold a statutory Public Hearing on October 20, 2015 at 11:00 am in the Council Chambers of the Annapolis Royal Municipal Administration Building to discuss Council’s intention to amend Part 7.21 of the Annapolis County East End Area Land Use By-law. Motion carried unanimously.
