Minutes of the regular session of Municipal Council held on September 15, 2015, at 10:00 a.m. in Council Chambers of the Municipal Administration building, Annapolis Royal, N.S.



Present: Warden Reg Ritchie, Deputy Warden Timothy Habinski; Councillors Marilyn Wilkins, Brian “Fuzzy” Connell (10:08) Paul McDonald, Gregory Heming, Frank Chipman, Martha Roberts, Diane LeBlanc, and Horace Hurlburt.

Absent:   Councillors Wayne Fowler and Alex Morrison

Also

Present:   CAO John Ferguson, Municipal Clerk Carolyn Young, other staff.



The Warden noted the following for the information of Council: Building Inspector Danny Wright is home and improving but not ready for visitors yet; Councillor Fowler has had a fall and injured ribs, discs and a hip so he will not be in attendance today; and Councillor Morrison was supposed to attend an announcement at Clark Rutherford Consolidated School on behalf of the Warden, but he is home under the weather and will not be in attendance at the announcement or at Council today.



Re: Special Council Session, Monday September 21st – the Warden inquired if Council would entertain holding a special session of Council immediately following the PAC public meeting being held Monday September 21st at 7:00 p.m. at the Nictaux Fire Hall regarding an application to amend the East End Area Land Use Bylaw. It was agreed to hold a special session of Council immediately following the public meeting on Monday, September 21st.



Additions to the Agenda

The following items were added to the agenda: 11(A) Canadian Wildlife Service – S5 Orderly and Peaceful Conduct Bylaw Exemption, (B) 36 Queen Street, and (C) Change name of agenda item 5 to Bridgetown Lions Bus Shelter.



Approval of the Agenda

Upon motion of Councillors Chipman and McDonald, the agenda was approved as amended. Motion carried unanimously.



Minutes



MOTION 150915.01              Minutes Regular Session August 18, 2015

Councillor Chipman moved, seconded by Deputy Warden Habinski, that the minutes of the regular session of Municipal Council held on August 18, 2015, be approved as circulated. Motion carried unanimously.  

MOTION 150915.02              Minutes Special Session September 8, 2015

It was moved by Councillor Wilkins, seconded by Councillor Heming, that the minutes of the special session of Municipal Council held on September 8, 2015, be approved as circulated. Motion carried unanimously.  





In-Camera

It was moved by Councillor McDonald, seconded by Deputy Warden Habinski, to meet in-camera in accordance with Sections (a) and (g) of the Municipal Government Act, from 10:07 a.m. until 11:00 a.m. Motion carried unanimously.



Public Hearing

It was the consensus to adjourn at 11:00 a.m. for a Public Hearing concerning the de-registration of the municipally-registered heritage property known as the Entertainment House in Granville Ferry. See separate minutes. The regular meeting reconvened at 11:10 a.m.



Additions to the Agenda (cont’d)

Councillor Wilkins moved, seconded by Deputy Warden Habinski, that Lease Agreement - Suite 2-5 Basinview Centre, De-Registration of Entertainment House An Annapolis County Municipally-Registered Heritage Property, and PID 05047840, be added to the agenda as items 11 (D), (E) and (F). Motion carried unanimously.



In-Camera

Deputy Warden Habinski moved, seconded by Councillor Heming, to meet in-camera in accordance with Sections (a) and (g) of the Municipal Government Act, from 11:10 a.m. until 12:15 p.m. Motion carried unanimously.



LUNCH

Upon motion of Deputy Warden Habinski and Councillor Hurlburt, Council adjourned for lunch at 12:16 p.m. and returned at 1:30 p.m. with all in attendance as previously noted, except Councillor Wilkins.



Business Arising from the Minutes



Re: Bridgetown Lions Bus Shelter – Several pieces of correspondence were received from the Bridgetown Lions (dated September 7, 2015; January 19, 2015, and October 25, 2014; and a copy of a letter from the Town of Bridgetown dated November 21, 2014). They have fundraised the total cost for a bus shelter within the boundary of the community of Bridgetown. The Deputy Warden commended the Lions for fundraising for this project, and he hoped that County can meet with them to help them move this project forward.

It was moved by Deputy Warden Habinski, seconded by Councillor LeBlanc, that the Warden send a letter of thanks and indicate that the CAO will arrange a meeting meet with the Lions and appropriate staff. Motion carried unanimously.



Municipal Solicitor’s Report



- Monthly Report

A report for the month of August was circulated in the agenda package. It was moved by Councillor Chipman, seconded by Councillor Hurlburt, to receive for information. Motion carried unanimously.



Councillor Comments



Bridgetown – Councillor Hurlburt noted the recent and very successful Ciderfest, even with threatening weather. Pie auction raised $1,600. He also noted that an RFP was recently awarded to local business Spicer Construction for preliminary work on the new P-12 school.



District 7 – Deputy Warden Habinski – proudly reported that the Paradise Refugee Support group family has arrived safely, are settling in their home in Bridgetown, and are busy learning English. He also noted the recent success of the first meeting of BUG - the Bridgetown Ukulele Group, successfully launched at the Bridgetown Library last evening with standing room only



District 1 – on behalf of Councillor Wilkins, the Deputy Warden read a letter dated September 7th from the Melvern Square and Area Community Association to the Warden – in thanks for the $2,400 grant received to assist with repairs to a portion of the roof.



District 5 – Councillor Heming noted the great attendance of 275 people at the Port Royal Family Fun Day held on Saturday, September 12th.



District 2 – Councillor Connell commented on another successful Wharf Rat Rally held in Digby, noting that it positively impacts local businesses and hotels for miles around. He added that the Mount Hanley School Museum will be hosting a fund-raising turkey supper on September 26th at the Port George Community Recreation Centre.  



District 4 – Councillor McDonald noted the Medway Community Forest group will host Dale Preist, who will present Working Conservation and Carbon Storage on Private Woodlots, at the community room of the Mersey Tobeatic Research Institute on Wednesday, September 23rd.



District 8 – Warden Ritchie reiterated the great afternoon and great crowd in attendance at Port Royal Family Fun Day.

Re: Committee of the Whole (September 8th)

·         East Dalhousie Road (0567) Renaming – Sections 001 & 002

In accordance with the recommendation of Committee of the Whole, Deputy Warden Habinski moved, seconded by Councillor Roberts, that Municipal Council approve the road renaming for Section #001 and Section #002 of the East Dalhousie Road (0567) (from Ridge Road to Cherryfield Road) to be renamed Camel Hill Road and have staff send the request and supporting documentation for the road name change to the Department of Transportation & Infrastructural Renewal for their approval. Motion carried unanimously.  

·         Wilmot Community Centre Society Grant

It was moved by Deputy Warden Habinski, seconded by Councillor Connell, in accordance with the recommendation of Committee of the Whole, that Municipal Council approve a 2015-16 grant in the amount of $1,800.00 to The Wilmot Community Centre Society in accordance with Policy AM 1.4.9 Community Grants. Motion carried unanimously.

·         Port Lorne Community Centre Association Grant

Pursuant to the recommendation of Committee of the Whole, Deputy Warden Habinski moved, seconded by Councillor Hurlburt, that Municipal Council approve a 2015-16 grant in the amount of $1,200.00 to The Port Lorne Community Centre Association in accordance with Policy AM 1.4.9 Community Grants. Motion carried unanimously.  



·         King’s Theatre Society Grant

It was moved by Deputy Warden Habinski, seconded by Councillor McDonald, pursuant to the recommendation of Committee of the Whole, that Municipal Council approve a 2015-16 grant in the amount of $2,000.00 to The King’s Theatre Society in accordance with Policy AM 1.4.9 Community Grants. Motion carried unanimously.  



·         Bridgetown Curling Club Grant

In accordance with the recommendation of Committee of the Whole, Deputy Warden Habinski moved, seconded by Councillor Hurlburt, that Municipal Council approve a 2015-16 grant in the amount of $5,000.00 to The Bridgetown Curling Club in accordance with Policy AM 1.4.9 Community Grants. Motion carried unanimously.

It was moved by Deputy Warden Habinski, seconded by Councillor LeBlanc, in accordance with the recommendation of Committee of the Whole, that Municipal Council proceed with a new ATM lease agreement with Direct Cash at Basinview Centre, Cornwallis Park. Motion carried unanimously.



·         Margaretsville Source Water Protection Plan

Pursuant to the recommendation of Committee of the Whole, Deputy Warden Habinski moved, seconded by Councillor Connell, that Municipal Council approve the Margaretsville Source Water Protection Plan as circulated. Motion carried unanimously.

·         AM-1.2.4 Policy Respecting Coat of Arms, Flag &Logos

It was moved by Deputy Warden Habinski, seconded by Councillor Hurlburt, pursuant to seven-day notice having been given, that Municipal Council amend Policy AM-1.2.4 Policy Respecting Coat of Arms, Flag & Logos by deleting a portion of Sub-sections 4.3 and 4.4. Motion carried unanimously.



Correspondence



Re: NS Municipal Affairs (August 21st) – from the new Minister of Municipal Affairs Zach Churchill, noting his intent to meet with Council in the next few months to listen to concerns and learn about what matters to Council and our residents. Councillor Chipman moved, seconded by Councillor Heming, to receive for information. Motion carried unanimously.



Additions to the Agenda



Re: Canadian Wildlife Service – S5 Orderly and Peaceful Conduct Bylaw Exemption – email correspondence dated September 14th was received, requesting Council to consider a change to the exemption that had already been granted to conduct night banding of ducks on September 18th and 19th, and requesting a change to conduct banding on September 19th and 20th.

Councillor McDonald moved, seconded by Councillor Connell, that the Canadian Wildlife Service be permitted to band ducks on the nights of September 19th and 20th, rather than the 18th and 19th as previously approved. Motion carried unanimously.



Re: 36 Queen Street – Deputy Warden Habinski noted the Request for Proposal (RFP) process for a tenant to fill the empty space at 36 Queen Street resulted in one failed negotiation. He inquired if follow up would be conducted with any other proponent who submitted in response to the RFP.



It was moved by Deputy Warden Habinski, seconded by Councillor Heming, that staff be directed to follow up with any other proposals that may have been received in response to the Request for Proposals for 36 Queen Street. Motion carried unanimously.



Re: Deregistration of Entertainment House, an Annapolis County Municipally-Registered Heritage Property

Deputy Warden Habinski moved, seconded by Councillor Heming, in accordance with a new request from the property owners Jack and Patricia Slater, that the Entertainment House remain on the register of heritage properties in the County of Annapolis. Motion carried unanimously.



Re: Lease Agreement - Suite 2-5 Basinview Centre

Deputy Warden Habinski moved, seconded by Councillor Hurlburt, that the Warden and Clerk be authorized to enter into as standard-form lease agreement with JLD's Esthetics and Gel Nails for Suite 2-5 at the Basinview Centre, Cornwallis Park. Motion carried unanimously.



Re: Property in Greenland PID 05047840

It was moved by Deputy Warden Habinski, seconded by Councillor McDonald, to have the CAO engage a Forrester to assess municipally owned PID 05047840. Motion carried unanimously.
