1.       Welcoming Remarks - Warden Reg Ritchie

Format:  Council is to deal with the second and last public hearing.  At the end of the public hearing the Public Hearing will be closed and Council will return to its regular session of Council.

Purpose:  The purpose of a Public Hearing is to permit members of the public to make their views known to Council, via oral or written submissions, concerning, solely, the application before Council.

The 2nd Public Hearing is to inform the public of Council’s intention to enter into a development agreement with Milton Hamilton and Janice King-Hamilton to permit the redevelopment of the property, identified as Property Identification Number 05149653 and civic address 51 Church Street in the community of Bridgetown.

Procedure:  all questions and comments throughout the public hearing are required to be addressed to the chair.  The chair will afford an opportunity for public input and will ask that persons speaking identify themselves so that their comments may be recorded in the minutes of these proceedings and that the person speaking identify if they are speaking in favour or against the application.  Written presentations are acknowledged first, followed by public oral presentations.  Questions and comments from Council members are asked to be held until all public comment is heard.

3.       Planning Process Next Steps (Planner)

a.              MGA 230 (1) states Council adopts a DA by policy.

b.             Only after holding a public hearing – MGA 230 (2).

c.              Motion to approve entering into DA – today or later?

d.             Council Direction – all contracts to be reviewed by Solicitor.

e.              Must be later due to (d) above? Council can clarify (d) direction.

f.              Voting procedures – MGA 230 (3) only those council members present at the public hearing may vote on the DA.

g.             MGA defines separate processes for approval or rejection of a DA

h.             After approval - ad placed in local paper setting out right to appeal (14 days after)

i.               Only after appeal period passes or appeals heard by NSURB can Council enter into DA (Warden & Clerk sign)

j.               DA does not come into effect until the DA is filed by the municipality in the Registry of Deeds (developer’s cost)

k.             MGA 228 (2), Council can stipulate period the DA must be signed by the property owner
